By creating an account, accessing, or using the RV SMART Garage mobile application and web platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and D12 Development LLC ("Company," "we," "us," or "our"), a limited liability company registered in the Commonwealth of Virginia. If you do not agree to these Terms, do not use the Service.
You must be at least 16 years old to use the Service. By agreeing to these Terms, you represent and warrant to us that: (a) you are at least 16 years old; (b) you have not previously been suspended or removed from the Service; and (c) your registration and your use of the Service is in compliance with any and all applicable laws and regulations.
To access certain features (such as Garage Management and AI Assistance), you must register for an account. You agree to provide accurate, current, and complete information during the registration process.
The Service allows you to upload vehicle details, maintenance records, receipts, and PDF manuals ("User Content").
Data related to your personal vehicles, maintenance history, and receipts remains your property. You grant us a license to host, store, and display this data solely for the purpose of providing the Service to you.
A core feature of the App is the ability to upload vehicle manuals/documents ("Manuals") to be shared with the community.
You agree not to upload content that is illegal, offensive, pornographic, infringing on intellectual property rights, or contains malware. We reserve the right to ban users who upload such content.
The Service includes an AI-powered assistant designed to provide guidance on maintenance and troubleshooting.
The Service may display vehicle recall information, safety ratings, or technical service bulletins sourced from third-party government databases, such as the National Highway Traffic Safety Administration (NHTSA).
RV SMART Garage operates on a "Freemium" model. Some features are gated behind a paid subscription ("Premium").
The Service, including its "RV SMART Garage" branding, logo, source code, and design, is the exclusive property of D12 Development LLC. You may not copy, modify, or distribute the App itself without our written permission.
You grant D12 Development LLC a perpetual, irrevocable, worldwide, royalty-free license to use your User Content to create anonymized, aggregated statistical data ("Aggregated Statistics"). D12 Development LLC shall own all right, title, and interest in and to the Aggregated Statistics, and may use them for any purpose, including displaying them publicly or within the App (e.g., "Average Maintenance Costs"), provided that such data does not identify you personally.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms (e.g., uploading offensive content). Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or request account deletion via the app settings.
D12 Development maintains a zero-tolerance policy toward any form of child sexual abuse and exploitation (CSAE). This includes, but is not limited to, child sexual abuse material (CSAM), grooming, sexual extortion, and any conduct that sexualizes minors. We strictly prohibit: Uploading, creating, possessing, distributing, or promoting any CSAM. Soliciting, engaging in, or facilitating any sexual activity with a minor. Using our services to groom, exploit, or harm children in any way. Violations of this policy will result in immediate account termination, removal of offending content, and reporting to the appropriate law enforcement agencies and the National Center for Missing & Exploited Children (NCMEC) or other relevant authorities. We cooperate fully with law enforcement in the investigation and prosecution of CSAE offenses. Any suspected CSAE activity will be reported and preserved in compliance with applicable laws. We provide an in-app feature for users to contact us. Users must report inappropriate content or behavior. All reports related to CSAE and CSAM are treated with the highest priority and reviewed immediately. If you encounter any content or activity that may involve CSAE, you must report it immediately to us via the app's support link or emailing us at support@d12development.com and, if applicable, to the NCMEC CyberTipline at https://www.missingkids.org/gethelpnow/cybertipline.
To the maximum extent permitted by applicable law, in no event shall D12 Development LLC be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.
